Unlike many states, Texas requires licensing for mold assessment and remediation, administered by the Texas Department of Licensing and Regulation. The framework exists because of documented industry abuses, and it is meaningfully enforced.

For a property owner, this is useful. It gives you a way to verify credentials rather than relying on marketing claims.

The License Types

The Separation Rule

This is the most important rule for consumers to understand. Texas Occupations Code Section 1958.155 prohibits the same company from performing both the assessment and the remediation on the same project. It also bars a person from owning an interest in both firms working the same job.

The purpose is straightforward: a company that profits from remediation should not be the one deciding how much remediation is needed. Texas adopted this after the industry demonstrated the conflict was real. The only narrow exception is a school district working on its own buildings.

Why This Protects You

It means the assessment you receive is not a sales document. The assessor gains nothing from finding a larger problem, because they cannot bid the remediation.

It also means a company offering to inspect your property and then remediate what they find is describing something Texas does not permit. That is a useful screening question.

Verifying a License

TDLR maintains a public license search. Verify the license type matches the work being proposed, confirm it is active, and check for disciplinary history.

Ask for the license number in writing before work begins. Legitimate licensed professionals provide it without hesitation.
